These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Typedream LLP (“Typedream”, “we”, “us”, “our”) governing your access to and use of the skn.coach websites, applications, and related services (collectively, the “Service”).
BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICE.
1. Eligibility and authority
- You must be capable of forming a binding contract under applicable law.
- If you use the Service on behalf of an entity, you represent and warrant that you have authority to bind that entity and that “you” includes that entity.
2. No medical advice; no diagnosis
The Service provides informational content, routines, and insights based on the information you provide (including photos and product information). The Service is not a medical device and does not provide medical advice, diagnosis, or treatment.
YOU UNDERSTAND AND AGREE THAT YOU USE THE SERVICE AT YOUR OWN RISK. IF YOU HAVE A MEDICAL CONCERN, ALLERGY, IRRITATION, OR A MEDICAL EMERGENCY, SEEK IMMEDIATE CARE FROM A QUALIFIED HEALTHCARE PROFESSIONAL.
3. Accounts; security
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate information and keep it up to date.
4. User Content; license
You may submit content such as selfies, progress photos, product photos, and notes (“User Content”). As between you and Typedream, you retain ownership of your User Content, subject to the licenses granted in these Terms.
You grant Typedream a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, modify (for technical purposes), communicate, and use your User Content solely to provide, maintain, secure, and improve the Service, including generating outputs for you, customer support, enforcing these Terms, and preventing fraud and abuse, in each case in accordance with our Privacy Policy.
You represent and warrant that (a) you own or have all rights necessary to submit the User Content, and (b) the User Content and its submission and use as contemplated by these Terms will not violate any law or infringe any third-party rights.
5. Acceptable use; prohibited conduct
- You will not misuse the Service or attempt to access it using a method other than the interface provided by Typedream.
- You will not interfere with, disrupt, or compromise the integrity or security of the Service.
- You will not upload, transmit, or otherwise make available any content that is unlawful, harmful, misleading, defamatory, infringing, or violates the rights of others.
- You will not reverse engineer, decompile, disassemble, or attempt to derive source code from the Service except to the extent such restriction is prohibited by law.
6. Subscriptions; billing
Certain features may be offered on a paid subscription basis. Payments may be processed by third parties. Subscription terms, renewals, refunds, and cancellations are governed by the applicable app store’s terms and your app store account settings unless otherwise stated in the Service.
7. Third-party services; links
The Service may integrate with or provide access to third-party services (including payment processors, analytics providers, and cloud service providers) or link to third-party websites. Typedream does not control and is not responsible for third-party services, and your use of third-party services may be subject to separate terms and policies.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TYPEDREAM LLP AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TYPEDREAM LLP’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Typedream LLP and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.
11. Suspension; termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, pose a risk to the Service or other users, or if required by law. Upon termination, the rights granted to you under these Terms will cease.
12. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. If we make material changes, we will update the “Effective date” and may provide additional notice.
13. Governing law; jurisdiction
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Subject to applicable law, you agree that the courts located in Uttar Pradesh, India will have exclusive jurisdiction over any dispute arising out of or relating to the Service or these Terms.
